A Texas man has been sentenced to three years in prison for illegally selling counterfeit Viagra. The case was announced by a Texas federal judge today in Houston.

The man was sentenced to three years’ probation for selling counterfeit erectile dysfunction pills. He was also ordered to pay $750,000 in restitution to his former employer, Apotex Pharmaceuticals, which paid for the pills. He pleaded guilty and was given a three-year prison sentence.
“A counterfeit drug is an extremely serious criminal enterprise,” Doherty said. “If you have to sell a counterfeit drug, you’re putting your lives at risk and it’s putting your future at risk.”
Apotex is also seeking restitution of $500,000 to Apotex Pharmaceuticals and $100,000 to the United States National Institutes of Health.
The case was prosecuted by Assistant U. S. Attorney Paul G. McConathy.
The trial began March 27 and is expected to last about two weeks. Judge Doherty’s decision is expected to be appealed by the Federal Bureau of Investigation. The case will then be considered at a later date, with sentencing on May 13.
